INTRODUCTION

Welcome to my Online Group Coaching Program for Practitioners. These Terms of Participation set out all the details you need to make an informed decision about whether this training is right for you right now, as well as explaining how all the moving parts fit together, so you can get the most value from your investment. It is essential that you read this document carefully before enrolling in the Program.

It is a condition of enrolment that you accept these Terms of Participation. By doing so, you are entering into a legally binding contract, so please contact me, ask questions, and clear up any confusion or concerns before you enrol. I encourage you to talk to me about any part of these Terms which feel unfair to you.

My intention in offering this Program is to simplify the issues surrounding histamine intolerance and methylation so that Practitioners can learn and apply the relevant principles in their own practice. There has been so much complicated biochemical research on this topic that it can be overwhelming and confusing for those who wish to help their patients but don’t have the time or the desire to specialise. I will be taking the best of the current research and demonstrating how to apply it clinically, as I have been doing for the past 9 years in my own practice.

This program has been designed primarily for naturopaths, nutritionists, doctors, integrated doctors, health coaches, and other health practitioners. It is not suitable for patients. You will get the most out of this Program if you ensure that you have set aside time to watch all the webinars, ask questions, and participate in the group coaching calls. The more you engage, the more you will learn.

By enrolling in this program, you agree that you are over the age of 18 and willing to be bound by these Terms of Participation.

PROGRAM DETAILS

This is an 8-week group coaching program. Places are strictly limited. You will receive access to 9 pre-recorded webinars which will be discussed in a weekly group coaching call. There will be a maximum of 10 people in each cohort, so you will have ample opportunity to ask questions and integrate your learning from the webinars.

The Program will be held 4 times per year. Please ensure that you enrol in the cohort that suits you best, so you will be able to attend all the calls.

All Program materials are available through my Kajabi content portal, along with full details about how the Program will be delivered. You will receive access to the portal one week before the course commencement date. Coaching calls will be held on Zoom. These calls will be recorded, but it is important to attend as many calls as possible in person, so you can receive the benefit of group discussion andaccountability.

Enrolment gives you ongoing access for the life of the Program. All participants will receive 1 months’ notice and be prompted to download the Program content if the Program is going to be closed.

COMMUNICATION POLICY

I prefer to be contacted by email during business hours, and we will respond to your email as soon as practicable. Please write “Urgent” in the subject line if you require a more immediate response.

You consent to receiving transactional emails, reminder emails, direct communication emails, newsletters, and special promotion emails from us. You understand that you can unsubscribe at any time.

PAYMENT

The full cost of the Program is $4400.

You may either pay $4400 upfront or take advantage of a 3-month payment plan which is 3 x monthly payments of $1566.

Your payment is processed online using Stripe. Any payment details you enter are stored under Stripe’s security policy.

It is your responsibility to ensure that you have sufficient funds available in your account. If payment fails, Stripe will attempt to process the payment twice more. If payment still fails to go through, your participation in the Program will be suspended while I contact you to remedy the situation. You will not be permitted to return to the Program until your payments are up to date unless I agree to make alternative arrangements. I reserve the right to charge an administrative fee of $27.50 on late payments if I must contact you to arrange payment.

Payment plans are offered solely to assist you in making this investment in your professional development. Once you start the Program you commit to paying the total amount due, even if you choose to withdraw before completion. This is because you receive access to my intellectual property and all the Program resources when you enrol. If I agree to an alternative arrangement with you, the terms of that arrangement must be strictly complied with.

You agree to pay all costs, including debt collection agency fees and solicitor’s costs that I may incur in taking steps to recover any money that you owe under these Terms of Participation, whether or not legal proceedings are issued in relation to the debt.

All amounts are in Australian dollars and are inclusive of GST.

REFUND POLICY

There are strictly no refunds if you change your mind after enrolling, as you will have had access to the content portal, which contains my intellectual property and all the Program resources. You will also have taken a place in the strictly limited cohort which could have been used by someone else.

If you are not satisfied with the resources for any reason, please email me to discuss your concerns.

If you prevented from attending calls or participating fully in the Program due to circumstances beyond your control, please contact me to discuss your situation. Any alternative solutions will depend on the nature of the emergency and will be offered at my sole discretion.

MY PROMISE TO YOU

I will provide thorough and comprehensive step-by-step guidance for treating patients with Histamine & Methylation issues so you can confidently treat these conditions in your own clinic. I will share my learning and experience from the past 9 years, along with the latest evidence-based research. I will conduct the Program ethically and with integrity and answer all your questions to the best of my knowledge and experience.

YOUR RESPONSIBILITY

When you choose to participate in in this Program, you are making a commitment to show up and do the work, and you are asking me to hold you accountable during this process. As a result, it is essential that you conduct your research and confirm that you are ready to undertake this professional development before you enrol in the Program.

I expect you to take full responsibility for your own engagement. How much effort you put in to the Program will determine how much benefit you receive.

You will need to review the Program resources & attend the calls to get as much out of this Program as possible.

PROGRAM LIMITATIONS & DISCLAIMERS

While my treatment plans are evidence-based and I am confident in the quality of my recommendations, I am not a medical professional. I do not diagnose specific illness or disorders. My Program is intended to support you to care for your patients’ wellbeing and, depending on the nature of your qualifications, what you learn may not be a substitute for appropriately qualified medical treatment, especially if your patient has a serious medical condition.

You take full responsibility for exercising your own professional judgment when implementing any suggestions that I may make during the Program. You understand that my advice is limited to providing you with options for your consideration, and that you are solely responsible for any actions that you choose to take when treating yourself or your patients. What works well for one patient may differ greatly for another. Even with our experience and knowledge of supplements and their application, there is a risk that patients may experience an unforeseeable reaction. Your duty of care requires that manage this risk to your patients appropriately. You agree to indemnify me against all consequences arising directly or indirectly from your choices.

If you are a student, you will learn about a speciality area that is not taught at university. It will give you a general understanding and background knowledge of the topic but is not a substitute for completing your studies and developing your own professional practice standards.

While I make all reasonable efforts to ensure that this Program meets with the highest standards of best practice, if something does go wrong that is not a direct result of my negligence, misrepresentation or deliberate fault, you agree that, to the fullest extent permitted by law, I will not be liable for any loss, damage, illness or injury you may suffer as a result of your participation, irrespective of whether it was foreseeable, and regardless of the nature of the claim.

You expressly agree that if this limitation of liability is unenforceable for any reason, my total cumulative liability for all causes of action of any kind, other than negligence or deliberate wrongdoing, shall not exceed the amount that you have paid to me for this Program.

GUARANTEE OF RESULTS

It is my intention that, if you give this program your full attention, watch all the videos, attend all the calls, and engage thoughtfully with the materials, you will be proficient in treating patients with histamine and methylation issues. For this to happen, you need to be a competent practitioner to begin with. You will need to have all the necessary skills and qualifications and be committed to operating on best practice principles.

Despite my intentions, I cannot offer any guarantee of results.

While I have observed that many people with histamine or methylation issues generally enjoy greater health and wellness when they follow the principles communicated in my Program, I do not promise or guarantee that your patients will experience improvement of their current symptoms or protection from future illness.

Everyone is unique. How your patients feel and how they respond to the treatment plans developed for this Program will depend on a wide range of factors beyond our control, including each patient’s individual metabolism, level of commitment, genetic and lifestyle factors.

CONFIDENTIALITY

In providing this Program I will collect personal and sensitive information from you, including your name, contact details, and information about your qualifications and practice. I collect this information to maintain my client database and deliver the Program to you.

I take your right to privacy very seriously. Your personal information will be stored securely and kept completely confidential. Access to your confidential information by my administrative team is on a strictly need-to-know basis and all team members are subject to strict confidentiality agreements. Please be mindful of the sensitive material we share. While the calls are intended to be a safe place to discuss patient problems and difficult cases, strict principles of confidentiality apply. You must not share anything you learn about other participants or their patients outside the calls.

Confidentiality is essential. Breaching another participant’s confidentiality (including mine) will be taken extremely seriously. At the same time, remember that calls are being recorded. You will need to anonymise patient details, and refrain from sharing anything with the group that is especially sensitive.

INTELLECTUAL PROPERTY

I will be sharing my trade secrets, confidential information, and content that I have created for this program through the content portal and in our calls (“my intellectual property”).

My intellectual property is provided solely for your professional development and must not be shared, discussed, or disclosed to anyone. The sole exception is the provision of information to patients on a need-to-know basis, while providing your services to them as contemplated under this agreement. You are expressly prohibited from claiming our intellectual property as your own.

RESPECTFUL COMMUNICATION

Disrespectful or aggressive behavior towards me, my team, your fellow participants, or anybodyelse will not be tolerated.

If a disagreement arises, you agree that you will not engage in any public discussion about the issues, will behave politely, and will avoid any conduct or communication which might reasonably be expected to interfere with my business or personal interests, or those of any other participant. You agree to act in good faith and be reasonably cooperative while we attempt to find a solution. I will treat you with the same consideration.

DISPUTE RESOLUTION

If there is a problem, you agree to meet with me in good faith to discuss your concerns and try to make a genuine effort to find a win-win solution. If the problem cannot be resolved within a reasonable time, you agree to pursue mediation and alternative methods of dispute resolution, with litigation being a last resort. I commit to making a similar effort to resolve any disputes in a friendly manner.

JURISDICTION

This agreement is subject to the governing law of New South Wales, Australia. Regardless of where you live in the world, you irrevocably agree that if the dispute resolution processes fail, the courts of New South Wales, and the Commonwealth of Australia, will have exclusive jurisdiction.

SEVERABILITY

If any part of this Agreement is held to be void, illegal or unenforceable, it can be removed without affecting the validity, legality, or enforceability of any other part of this Agreement.
